BIS Adds Twenty-Seven to Entity List, Revises One

On January 16, 2025, the Department of Commerce, Bureau of Industry and Security (BIS) published two rules (90 FR 4617 and 90 FR 4621) adding twenty-six entries to the Entity List. The new additions are located in:

  • People's Republic of China (China) (25)
  • Singapore (2)

The new listings target production and development of advanced integrated circuits for Chinese military end-use.

The Entity List, found at Supplement No. 4 to Part 744 of the Export Administration Regulations (EAR), restricts exports of U.S.-origin goods and technology to listed parties. For these additions, the restrictions create a license requirement with a presumption of denial for all exports, reexports, or transfers subject to the EAR. This includes items classified as EAR99 or other items that would otherwise be shipped No License Required, or NLR.

BIS also removed three entities of the Indian Department of Atomic Energy (“Indian Rare Earths,” “Indira Gandhi Atomic Research Center (IGCAR),” and “Bhabha Atomic Research Center (BARC)”).  As revised, the Entity List still lists facilities of concern in India, while allowing bilateral collaboration on critical minerals and clean energy supply chains.  With the removal of BARC, IGCAR, and India Rare Earths from the entry on the Entity List, a license is no longer required for exports to these three entities unless the end use is listed in § 744.2 of the EAR.
