BIS Adds 123 to Entity List, from Canada to Kyrgyzstan

On August 27, 2024, the Department of Commerce, Bureau of Industry and Security (BIS) published a rule (89 FR 68544) adding thirty-seven entries to the Entity List. The new additions are located in:

  • Canada (1)
  • People's Republic of China (China) (42)
  • Crimea Region of Ukraine (1)
  • Cyprus (1)
  • Iran (11)
  • Kazakhstan (1)
  • Kyrgyzstan (1)
  • Russia (63)
  • Turkey (8)
  • Ukraine (1)
  • United Arab Emirates (UAE) (1)

BIS also published a press release on these additions and other related actions.  Reasons for addition to the Entity List were centered around support for Russian military and/or defense industrial base.

The Entity List, found at Supplement No. 4 to Part 744 of the Export Administration Regulations (EAR), restricts exports of U.S.-origin goods and technology to listed parties. For these additions, the restrictions create a license requirement with a presumption of denial for all exports, reexports, or transfers subject to the EAR. This includes items classified as EAR99 or other items that would otherwise be shipped No License Required, or NLR.

With the inclusion of parties located in NATO allies Canada and Turkey, this action is reminder of the importance of screening customers in all countries.
