Weapons of Mass Destruction Trade Control Regulations: OFAC Removes an Empty List

In a bit of regulatory cleanup, the Department of the Treasury's Office of Foreign Assets Control (OFAC) published a notice (86 FR 73105) on December 27, 2021, removing an appendix to the Weapons of Mass Destruction Trade Control Regulations.

Under the Weapons of Mass Destruction Trade Control Regulations, designated persons (individuals or entities), including those listed in the appendix, were subject to prohibitions on the importation of "goods, technology, or services produced or provided by a designated foreign person."

Although all of the entities listed in the appendix "had been determined by the Department of State to no longer be subject to the import measures," they remained listed by OFAC as subject to the Weapons of Mass Destruction Trade Control Regulations prohibitions.

This action clarifies that the previously listed parties (eight entities in Russia) are not subject to the Weapons of Mass Destruction Trade Control Regulations and future designations will be made via Federal Register Notices and included on the Department of State's Nonproliferation Sanctions website.

OFAC also continues to maintain their own Non-Proliferation Sanctions program through the Specially Designated Nationals and Blocked Persons list.​
